What Does “Berry Compliant” Mean?
Berry Compliance refers to a federal requirement (10 U.S.C. § 2533a, the “Berry Amendment”) that mandates the U.S. Department of Defense (DoD) procure textiles, clothing, and related items only if all components and production are 100% U.S.-based. This includes:
· - Fibers, yarns, fabrics, coatings
- Cut-and-sew textile products (e.g., harnesses, lanyards)
- Textile components like webbing, thread, elastic
- All textile processing: spinning, weaving, dyeing, cutting, and stitching
Even a minor non-U.S. input—such as imported thread—can disqualify a product from compliance.

- Only 100% U.S.-origin materials and labor are allowed—no percentage thresholds or partial compliance.
- Berry applies to both end products and components; it covers all tiers of contract suppliers.
- Exceptions are rare, including:
- Waivers via Domestic Non‑Availability Determinations (DNADs)
- Small-value procurements under ~$150,000
